CONSTRUCTION BOARD OF ADJUSTMENTS AND APPEALS:


The Construction Board of Adjustments and Appeals discuss matters pertaining to property maintenance of existing residential and non-residential structures.  The Board also discusses appeals based on a claim that the true intent of the building codes or the rules legally adopted hereunder have been incorrectly interpreted, the provisions of the codes do not fully apply, or the requirements of the codes are adequately satisfied by other means, or that the strict application of any requirement of the codes would cause an undue hardship.

 

Membership

The City of Harlingen’s Construction Board of Adjustments shall consist of fourteen members, seven of which will be regular members and seven of which will be alternate members.  The composition of the board shall be composed of individuals with knowledge and experience in the technical codes, such as one professional engineer, one architect, one general contractor, one licensed mechanical contractor, one licensed plumber, one licensed electrician, and one citizen.  Each appointee to the Board shall be at least 18 years of age and must be a resident of the City of Harlingen or work or operate a business in Harlingen.  All appointees must be of good moral character and demonstrate an interest in the general welfare of the City.  The terms of office of the current members of the Construction Board of Adjustments and Appeals shall expire on May 15, 2004.  Thereafter the Mayor shall appoint two (2) regular members and two (2) alternate members and each Commissioner shall appoint one (1) regular member and one (1) alternate member to the new Board.  The members of said board shall serve concurrently with the Mayor or Commissioner’s term who appointed such member but in no case shall hold office for a term longer than the term of office of the Mayor or Commissioner making such appointment.  Each appointee member may serve shall not be limited.  In the event a member of the Board vacates office during his or her term, the Mayor of Commissioner who appointed the vacating Board member shall appoint a replacement who shall serve the remaining term of the vacating Board member.  A regular Board member shall forfeit his or her office is such appointee fails to attend three (3) consecutive meetings.  Members are removable for cause by majority of the City Commission upon written charges and after public hearing.
