AIRPORT BOARD:
The board shall have the duty and authority of the management, maintenance and operation of the airport (including the Industrial Airpark portion thereof), including but not being limited to the following specific powers and duties:
· Implement and enforce the rules and regulations set forth herein below; with such enforcement including the implementation and
coordination of security enforcement duties of the airport security force; and the implementation and coordination of law
enforcement duties of the police department of the City of Harlingen.· Employ a manager and such additional personnel as are necessary for the efficient operation of the airport, including the care of
airport property and administration of said rules and regulations, and the herein set forth authority and duties of the board.· Determine and designate personnel to be commissioned by the elective commission as Harlingen Airport Security Force personnel;
organize, specify and supervise the operations of the airport security force, directly or by delegation of all or a portion of such
supervision to its airport manager.· Negotiate, agree upon and enter into and execute leases of airport property, pursuant to the laws of the State of Texas;
therein determining the terms and conditions of such leases; provided, that such leases shall not exceed a term of twenty (40) years.· Grant permits by written contract, or other form of agreement or permit, to duly qualified and otherwise authorized entities to
furnish and operate commercial air transportation into and out of the airport, including the leasing and/or otherwise designation
of related activity and necessary space in the airport terminal and on the flight line of the airport.· Fix charges, rentals or fees for privileges or services furnished under such permit at the airport, which shall be reasonable and
uniform for the same class of privilege or service and shall be established with due regard to the property and improvements used
and the expenses of operation to the municipality.· Determine and designate the entities to be authorized, as aforesaid, to operate in an upon and the areas immediately surrounding
the terminal, and flight line.
Membership:
The Airport Board shall consist of five members, with each member to serve for a term of five years and with the beginning and ending of each respective five-year term to begin and terminate on successive years, whereby the term of each member of such Board shall begin and end in a year separate from the beginning and ending terms of the other members of the Board. The beginning date of each successive term shall be on March 1. On the expiration of each member’s term, a resident citizen of the city shall be appointed by the Mayor and approved by the City Commission as the replacement appointment. If a vacancy on the Airport Board occurs, such vacancy shall be filled by appointment by the Mayor and approval by the City Commission of a resident citizen of the city to serve the remainder of the term of such vacancy. In the event that upon the expiration of the term of any such Board member his or her replacement is not succeeded by appointment by the Mayor and Commission as herein provided for, such member shall nevertheless continue as a member of the Board until a replacement appointment is in fact made by the Mayor and Commission as herein provided for, with such replacement appointment to terminate on the regularly scheduled date as herein provided for.
